1. Acceptance of Terms By accessing or using Pawtastic, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not access the website or use any services.

 

2. User Accounts You may be required to create an account to make purchases. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User Content and AI Generation Licensing

  • Your Rights: You assert that you own or possess the necessary licenses, rights, and permissions to upload the photos you submit. You retain full ownership of the final AI-generated images produced by our service and may use them for personal or commercial purposes.

  • Our License: By uploading images, you grant Pawtastic a worldwide, non-exclusive, royalty-free, temporary license to use, reproduce, and process your images strictly for the purpose of generating your requested AI portrait and fulfilling your physical order.

4. Prohibited Uses You agree not to use the site to:

  • Upload any content that is unlawful, defamatory, obscene, pornographic, or harassing.

  • Upload images of individuals without their consent.

  • Violate the intellectual property rights of others (e.g., uploading copyrighted cartoon characters or celebrity photos). We reserve the right to cancel orders and terminate accounts that violate these rules.

5. DMCA Copyright Policy We respect the intellectual property of others. If you believe your copyrighted work has been infringed upon by a user on our platform, please send a written notice to support@pawtasticco.com including a description of the copyrighted work, its location on our site, and your contact information.

6. Dispute Resolution and Arbitration Please read this section carefully, as it affects your legal rights. Any dispute or claim relating in any way to your use of Pawtastic or to any products sold by Pawtastic will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement. There is no judge or jury in arbitration, and court review of an arbitration award is limited.

 

7. Limitation of Liability Pawtastic and its suppliers will not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of the service. Because AI generation is unpredictable, we do not guarantee exact likenesses or specific aesthetic outcomes. Our maximum liability to you for any claim shall not exceed the amount you paid to us for the product in dispute.
